Terms of Service

The agreement between you and us. It says what we owe you, what you owe us, and what happens when something goes wrong.

Last updated 29 September 2026

1. This agreement

These terms are between TODO: registered company name, TODO: company number and country of registration, TODO: registered address (“Tutorition”, “we”) and the organization or person using the service (“you”). By creating an account or using Tutorition you accept them. If you are agreeing on behalf of an institute, you confirm you are allowed to bind it.

2. What the service is

Tutorition is software that lets tutoring centers, test-prep academies and schools run mock tests, mark them, explain the answers, and offer career guidance. We provide the software. We are not an exam board, we do not award qualifications, and we are not affiliated with the College Board, ACT, ETS, GMAC, LSAC, IELTS or any UK exam board, whose names appear only to describe what a test prepares for.

3. Accounts and roles

  • An institute signs up and then creates accounts for its own staff and students. It is responsible for who it gives access to and for what they do with it.
  • Keep your password to yourself. Tell us promptly if you think someone else has it. You are responsible for what happens under your login until you do.
  • Accounts are for one person. Sharing a login between people is not allowed, and seats are counted per student.
  • We may suspend an account that is being used to break these terms, and will tell the institute why.

4. Free trial

New institutes get a one-day free trial, with no card required. The trial is for evaluating the product. When it ends, the account stops until a subscription starts; nothing is charged automatically, and your data waits for you.

5. Subscriptions and payment

In short

You pay us monthly or yearly in advance, per the plan you pick. It renews until you cancel. Cancelling stops the next renewal; it does not refund the period you are in.

  • Prices are shown on our pricing page in US dollars or pounds sterling and are exclusive of any tax we are required to add.
  • Subscriptions renew automatically at the end of each period at the then-current price. We give at least 30 days' notice by email before a price change affects you.
  • Payments are handled by Stripe. A failed payment puts the account past due; we will email you before access is affected.
  • Cancel any time from your billing page or by emailing us. Access continues to the end of the period you have paid for.
  • Refunds of our own subscription fees are covered by our refund policy.

See the Refund Policy.

6. When an institute charges its own students

In short

If an institute sells plans to its students through Tutorition, the institute is the seller. The money goes to the institute's own Stripe account, and the institute answers to the student for the course and for refunds.

  • The institute connects its own Stripe account and sets its own prices, in its own name. It is the merchant of record and the contracting party with the student.
  • We take a platform fee, shown to the institute before it connects, out of each payment. Stripe takes its own processing fee separately.
  • The institute is responsible for its own refund policy, for any tax it must charge or register for, and for what it promises students.
  • We are not party to the contract between an institute and its student, and we do not hold their money. If a payment is disputed by the student's bank, it is settled between the institute, the student and Stripe.

7. Acceptable use

You agree not to:

  • Upload content you do not have the right to use — including copying an exam board's or publisher's questions into the question bank.
  • Use the service to harass anyone, or to store material that is unlawful or abusive.
  • Try to break, overload or gain unauthorized access to the service, other institutes' data, or anyone's account.
  • Resell or white-label the service to third parties beyond the white-label features we provide to you.
  • Use automated means to extract the content or data of the service beyond the exports we give you.

8. Who owns what

  • You keep everything you put in: your questions, tests, branding, student records and results. You give us only the permission we need to host, process and show it inside the service for you.
  • We keep everything we made: the software, the design, and any AI prompts and templates we ship. Nothing here transfers our intellectual property to you.
  • Output the AI generates for you inside your account — explanations, drafts, reports — is yours to use. Check it before you put it in front of students; it can be wrong.
  • You can export your data at any time, and we will help you get it out if you leave.

9. Availability and support

We aim to keep the service available around the clock and to schedule maintenance outside exam hours, but we do not promise uninterrupted service unless a separate written agreement says so. Support is by email; we reply within one working day.

10. Disclaimers

Beyond what we expressly promise here, the service is provided as is. We do not promise that it will meet every requirement or that AI output will be accurate. Decisions you take about a student remain yours.

Nothing in these terms limits rights you have under consumer law that cannot be limited, or our liability for death, personal injury or fraud.

11. Liability

Neither of us is liable for indirect or consequential loss, or for lost profits, revenue, goodwill or anticipated savings. Our total liability to you for all claims in any twelve-month period is limited to the fees you paid us in that period.

12. Data protection

How we handle personal data is set out in the Privacy Policy. For student data, the institute is the controller and we are the processor; institutes can request a data processing agreement from us. Each of us will comply with the data protection law that applies to it.

13. Ending the agreement

  • You can stop using Tutorition and cancel at any time.
  • We can end this agreement if you break these terms seriously and do not fix it within 14 days of us asking, or immediately if the breach cannot be fixed.
  • When the agreement ends, your access stops. Your data is available for export for 30 days and is then deleted, apart from records we must keep.

14. Changes to these terms

We may update these terms. If a change reduces your rights or adds an obligation, we will email institute administrators at least 30 days before it takes effect, and you may cancel before then if you do not accept it.

15. Governing law

These terms are governed by the law of TODO: governing law and courts, and its courts have exclusive jurisdiction. If you are a consumer, this does not take away the protection of the law of the country you live in.
